Article 1: General Provisions
The e-commerce website of Comed BV, a BV with registered office in Bilzen-Hoeselt, VAT BE 1002761947, RPR Tongeren (hereinafter Comed), offers its customers the opportunity to purchase the products from its webshop online.
These General Terms and Conditions ("Terms") apply to every order placed by a visitor to this e-commerce website (“Customer”). Placing an order via the Comed webshop implies that the Customer has read these Terms and expressly accepts their applicability, to the exclusion of all other terms. Any additional terms from the Customer are excluded unless previously, expressly and in writing accepted by Comed.
Article 2: Price
All listed prices are expressed in EURO, always including VAT and any other duties or taxes to be borne by the Customer.
If delivery costs are charged, this will be stated separately.
The stated price applies only to the items as literally described. Accompanying photos are for decorative purposes and may contain elements not included in the price.
Article 3: Offer
Despite the fact that the online catalog and e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer do not bind Comed. Comed is only bound to a best-efforts obligation regarding the accuracy and completeness of the provided information. Comed is under no circumstances liable in case of material errors, typographical or printing mistakes.
If the Customer has specific questions regarding e.g., sizes, color, availability, delivery term or method, we ask the Customer to contact our customer service in advance.
The offer is valid as long as stock lasts and may be modified or withdrawn by Comed at any time. Comed cannot be held liable for the unavailability of a product.
Article 4: Online Purchases
When you confirm your order on our website, we receive an email confirming your purchase. Payments are processed by Ogone.
The Customer may choose between the following payment methods (complete/remove as applicable):
- via credit card (VISA or MasterCard)
The products/services offered through this e-commerce website constitute an offer subject to the condition of acceptance by Comed.
Comed is entitled to refuse an order (in writing) due to a serious shortcoming by the Customer concerning the order or any other agreement involving the Customer.
Article 5(a): Delivery and Execution of the Agreement
Items ordered via this webshop are delivered throughout Europe, Turkey, Tunisia, Taiwan, China, USA, and Canada.
Delivery is made by DPD, TNT, Bpost.
Unless otherwise agreed, goods are delivered to the Customer's residence within 30 days of order receipt. Air, road, and sea transport apply.
Any visible damage and/or qualitative shortcoming of an article or other shortcoming in delivery must be reported immediately to Comed by the Customer.

Article 12: Use of Cookies

Article 13: Invalidity – No Waiver

The failure at any time by Comed to enforce any of the rights listed in these Terms, or to exercise any right hereof, shall never be considered a waiver of such provision and shall never affect the validity of those rights.
Article 14: Changes to Terms
These Terms are supplemented by other terms explicitly referred to, and the general terms and conditions of Comed. In case of contradiction, these Terms prevail.
Comed may change these Terms at any time without prior notice. Any purchase after the change constitutes acceptance by the Customer of the new Terms.
Article 15: Evidence
The Customer agrees that electronic communications and backups may serve as evidence.
Article 16: Applicable Law – Competent Court
Belgian law applies, excluding the rules of international private law on applicable law and the Rome I Regulation on international sales contracts. Any disputes fall under the exclusive jurisdiction of the courts of Tongeren.
Article 17: Returns
Given the application of full chain control and HACCP standards, it is not permitted to return or credit food products.
Article 18: UNIZO E-Commerce Label
Comed has subscribed to the regulations of the UNIZO e-commerce label. A copy of these regulations and access to the UNIZO complaints procedure are available at www.unizo.be/e-commerce.
